FAIRMONT, W.Va. (WBOY) — The juvenile son of a man already convicted in the 2022 gang shooting death of Henry Silver in Marion County testified during another suspect’s trial on Tuesday.
Derek Clem was one of six people arrested and charged with Silver’s murder and is the third to go to trial. Court documents from the time of Clem’s arrest alleged that all of the suspects were members of the Pagan Motorcycle Club and met multiple times before Silver was shot by a group of people, including at least one wearing a ski mask.
Clem is charged with first-degree murder, conspiracy to commit murder, and use of a firearm in the commission of a felony.-00:39
His trial began on Monday, and the defense and state rested Tuesday afternoon after hearing from multiple witnesses, including family members of John Wolfe—the man already convicted of the murder, residents of the apartment building in Carolina where the shooting happened, and forensic investigators and experts.
Wolfe’s juvenile son testified that he had overheard the meeting where the suspects discussed “taking care of” Silver and said that his father had pointed out Silver to three men wearing ski masks. He also said that he witnessed the shooting and the three masked men leaving scene in the same truck that Clem was in earlier that day.
A Marion County investigator testified that Wolfe’s cellphone had contacted Clem’s three times on the evening of the murder. However, on cross-examination, the investigator admitted that no one identified Clem at the scene and that there was no direct evidence that Clem possessed a gun.
